HOME BUILDERS & REMODELERS ASSOCIATION OF CAPE COD (HBRACC)
CAR RAFFLE: MAY1, 2012 – OCTOBER 6, 2012
THE PRIZE: A 2012 Volkswagon Beetle Coupe valued up to $21,935, purchased by HBRACC. The winner is responsible for all taxes (sales and 1099), title and registration fees. The prize cannot be exchanged for cash. The vehicle will not be delivered until after all of the applied taxes, license and registration fees are paid by the winner. The winner must have proper identification when claiming the vehicle (a valid state driver’s license) and appropriate insurance as determined by Tracy Volkswagon Hyannis MA Dealership. If the winner elects not to accept the vehicle, no substitution or exchange for cash or other goods will be provided. HBRACC is not responsible for the vehicle’s quality nor shall it have any responsibility once the vehicle has been conveyed or delivered to the winner.
ELIGIBILITY: Only licensed drivers (license cannot be suspended), 18 years of age (on or before October 6, 2012) and older are eligible to participate and enter. To be eligible to win, entries must be completed and received by HBRACC in the format designated below. Board members of HBRACC and their immediate family members (spouse, parent, siblings and children) and/or those living in the same household (whether related or not) are eligible. HBRACC reserves the right to disqualify any entrant for violation of these Official Rules, any applicable laws, or anyone who makes any misrepresentations relative to this drawing of chance.
ENTRY IN DRAWING: Participation in this drawing by chance shall be through ticket sales or by means of an on-line process. Each ticket is $100. NO PURCHASE OR CONTRIBUTION IS NECESSARY FOR ENTRY. A maximum of 600 entries, which comply with these Official Rules, will be accepted, on a first come, first served basis. HBRACC is not responsible for any incorrect or inaccurate information, whether caused by computer users or by any of the equipment or programming associated with or utilized in connection with this drawing by chance. HBRACC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft, or destruction or unauthorized access to, or alterations of, entries. Incomplete or illegible entries are void. Entries may not be resold and no refunds or replacements will be issued.
HOW TO ENTER: You have not entered the Raffle until your entry submission, with full payment, has been accepted by HBRACC. Acceptance of your entry submission will be communicated to you by a ticket receipt with ticket number delivered via email from HBRACC, with return e-receipt requested. If a submission is accepted, then it will be deemed to have been accepted on the date and time on which the submission was received by HBRACC, regardless of the date that HBRACC notifies you of the acceptance of your submission. You may enter as often as you want, but all entry requirements must be met for each entry. Tickets will be sold until October 7, 2012 at 12:00pm or until 600 entries are accepted, whichever comes first. The drawing will take place on October 7, 2012 between 3:00pm and 4:00pm. There are 4 ways to submit your entry:
Submission by Mail: Legibly complete the official entry form and send it by first class mail, postage paid, along with required credit card information, or check to: Home Builders & Remodelers Association of Cape Cod, 9 New Venture Dr., So Dennis, MA 02660. Entrants are discouraged from sending cash, checks, money orders or other forms of negotiable instruments through the mail.
Submission by Internet: Access the official HBRACC website at www.capecodbuilders.org/raffle (“Auction Website”), navigate to the Car Raffle entry page, and complete the Raffle entry form by providing all requested information, and then clicking “submit.”
Submission in Person: Purchase your ticket in person from an authorized volunteer of HBRACC by completing the official entry form, and handing the completed official entry form, along with a check or required credit card information, to one of HBRACC volunteers present.
Submission by phone: Purchase your ticket over the telephone from an authorized HBRACC staff member or volunteer by providing entry and payment information to the volunteer. (Receipt by a volunteer of entry information and payment DOES NOT constitute acceptance of your entry submission.
ODDS OF WINNING: The odds of winning the Grand Prize will not exceed 1 out of 600, but may be more favorable depending on the number of entries. A minimum number of 450 tickets must be sold in order to hold the drawing.
PROCEDURES FOR LIMITING ENTRIES: The number of entries into the Raffle shall be limited to 600 using the following procedure:
If 600 submissions are accepted prior to the closing date of October 7, 2012 at 12:00pm, no further submissions will be accepted. Submissions received beyond 600 will be refused and, if necessary, entry fees will be returned or refunded.
HBRACC shall keep a daily tally of the number of submissions received and accepted, and the date on which they were received. In the event that more than a total of 600 accepted submissions are received, then HBRACC shall
determine the day on which 600 accepted admissions were received; and
if the daily tally for that day results in there being more than 600 accepted submissions, then
HBRACC shall randomly select from all accepted submissions received that day in order to achieve exactly 600 accepted submissions.
CUT-OFF/MAXIMUM ENTRIES: No entries will be accepted or distributed after October 7, 2012 at 12:00pm. Requests received after that date & time or after 600 entries have been received and accepted, will not be accepted and will be rejected.
MINIMUM NUMBER OF ENTRIES: A minimum number of 450 tickets must be sold, paid, and accounted for by October 7, 2012 at 12:00pm in order for the raffle to take place. In the event 450 minimum ticket sales are not reached by 11:59am on October 7, 2012 all entrants will be reimbursed in full within 15 business days of October 8 2012, postmarked by last business day of October 26 2012.
SELECTION OF AND NOTIFICATION TO WINNER: The winner will be selected at a random drawing at 9 New Venture Drive, So Dennis, MA 02660 on October 7th, 2012 between 3pm and 4pm by an independent judge whose decision shall be final and binding in all respects. Entrants do not need to be present to win. The winner will be notified by phone and by certified email if necessary, according to the contact information provided to HBRACC at the time of entry. The odds of winning the prize will depend on the number of entries. In the event a winner cannot be contacted, fails to respond within the required time frame, fails to otherwise qualify for the prize and/or declines the prize, an alternate winner will be selected. If not claimed within 14 days of notification, the winner designee will forfeit any rights to the vehicle and the same will be awarded to an alternate winner. The right to take possession of the vehicle through the winning entry is neither assignable nor transferable.
AFFIDAVIT & RELEASE: As a condition of being awarded the vehicle, the winner designee shall be required to execute and deliver to HBRACC a signed affidavit of eligibility, acceptance of these Official Rules and release of liability.
USE OF WINNER’S NAME AND LIKENESS: In consideration for being awarded and delivered the vehicle, the winner agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such person’s name and/or likeness in any and all advertising, promotions and other publicity in any media, worldwide, in perpetuity.
ON-LINE DONATION PROCESS: An eligible and qualified person desiring to enter this drawing by chance may do so on-line at www.capecodbuilders.org. Each ticket is $100 and must be paid in full on-line via credit card. Payment must be made in United States legal tender. Proof of reserved ticket(s) will be sent to the email address provided by the entrant.
TAXES AND DEDUCTIBILITY: Donations made in connection with this drawing of chance are not tax deductible. All federal, state and local taxes associated with the receipt and use of the vehicle are the sole responsibility of the winner. All federal, state and local taxes are based on the final actual retail value of the vehicle.

DISPUTE RESOLUTION: HBRACC shall resolve all disputes in its sole and absolute discretion.
GENERAL RELEASE: Each entrant releases HBRACC, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees, agents and successors from any liability whatsoever, and waive any and all cause of action, for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with or as a result of participation in this drawing by chance and if the winner, in acceptance, possession or use of the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
